i think by using it that way it would be legal as you are not using it for your own personal gain but you should first contact the band via website and ask for permission.

Many times in books i've read, the author gives reference to the song and artist, along with the year the song was made, on the copyright page. I do think that you need to ask for permission most times, ESPECIALLY if you plan on publishing the book

yes i'm pretty sure you can i mean i know i've read books with band names that are real in them plus if it's a hit seller the band might get some publicity, so they shouldn't care

can't see that statement as being a problem. You have not made any claim about the band itself.

As long as it's unpublished, don't worry about it. When/if you do eventually publish it, you should have an agent who'll check up on these things for you.
