I just got in a minor parking accident. While backing out i did not see anyone. Coast was clear. I was out of the parking. I looked in the rear view mirror and no one was there. I was about to drive forward but i was blocked. The person in front wanted my parking slot. I was stuck so i pulled back. a little more trying to make way. Then i hit someone. My back right corner of my 2007 civic was hit and the persons 1995 paseo was hit in the front fender left side . It seems she was pulling out too. Her car was almost clear of her parking slot when i backed up slowly (i just let go of the break) She was hit at an angle, and not bumper to bumper. I did not stop my car from rolling. I think its her fault because 1 i didnt get a warning honk. 2 because she shoulda seen me backing up. And stay in her spot. Whos fault?

Anyways shes giving me a hard time too. I gave her my number so she could get an estimate so that i can pay her. I told her to not report to the insurance company because i dint want my rates shooting up. 2 days later she came to me with some bogus repair estimates. I only damaged front fender of her car. But the repairs seem to be all over the car. So my brother knew a good bodyshop owner and gave me his #. I called her and told her that they arent crooked here and they will charge me cheaper. She makes up an excuse saying it was too far. (20 minute drive) Less if you take the freeway. This girl seems to have made a deal with the other bodyshop owners so she could make extra cash on me. Should i just report to insurance company and take the bills up the butt?

If she tries to bring me to court to score moolah off me. Can i sue her back for trying to fraud me? With the estimates, about the repairs all over the car?

The principle of the last clear chance applies on this case, you are not liable because the driver of the car who bumped you has the last opportunity to prevent the accident.

1. Warning honks are not necessary.
2. Perhaps you should have seen her backing up, since she made it almost out of her spot when you hit her.

It's been my experience, that even if it's your fault, you should let the insurance handle it (I've been involved in an accident I paid for out of pocket and ended up forking over cash for repairs and for a rental car).

It is probably both of your faults. Your's for not double checking while backing up and hers for not double checking when she pulled out. She saw you leave and didn't expect you to back up.

I, as a rule of thumb, never back up to allow someone to take my parking spot. They will give up and leave and if they don't I pull back in and park the car.

From your facts, it sounds like you admit "you hit someone", so you understand that you were the one in the wrong. If you were the one backing up, you are presumed to be the one at fault.

It sounds as if you are both at fault, and yes I would let the insurance company handle it.
