Congress writes and passes the laws. The Judiciary enforces them and the Supreme Court determines whether or not the law is constitutional. Freedom of Speech is a constitutional issue.

No its the place of the Supreme Court based off their interpretation of the constitution and prior legal precedent.

Well, since congress makes laws, it is at least partly their place.

The other group, of course, would be the courts, who determine the constitutionality of those laws.
