I am in a difficult boat right now. I left from my previous employer and have documentation of them harassing and discriminating against me (all the way to the CEO). Unfortunately my suit isn't in a 'protected class', so I was going to release it to the media in hopes to enlighten the community and tarnish their reputation. I told them that I wouldn't want to and am willing to make an offer. The CEO wrote me back wondering what my offer was.

As I have not discussed money what-so-ever at this point, I'm not sure if it would be considered blackmail and then they would sue me back.

Any help would be much appreciated!

Suggesting in public that you want to tarnish their reputation and/ or extort/ blackmail them isn't a good start. Get a lawyer to pursue legal and ethical actions against them for breaking the law by discriminating against you. If they didn't break the law or discriminate against you (what's this non-protected class you're in??), then you don't have any recourse, so tarnishing their reputation in the press or anywhere else will get YOU sued.

You are walking on thin ice. GET A LAWYER NOW. Just stop reading right here and call one before you end up in jail for extortion.
