I am helping out a friend here, her husband does not want to sign the divorce papers is there some legal way to make him sign the papers, they have been seprated for one yr.
any help will do.

No you cannot make someone sign anything.

A divorce will eventually occur. Nobody can stop it, but it can be frustrated.

Methinks your friend is someone you want to get into bed with.

Tell her to ask an attorney what to do. Uncontested divorces are faster, but he cannot stop it forever.

I had the same situation with my ex. My lawyer said... so what, we can still file the papers, have an officer server her the papers and go to court. If she doesn't show up... we can still go on with the proceedings and get your divorce. She didn't show up and my ex asked me eight months later... are we divorced? I'm afraid so!!

depends on the laws in your state. in my state divorce is "no fault" and he wouldn't have to sign it, she would just have to serve him with the papers. check with an attorney, often they will give a free consultation.

well it goes thru whether he signs them or not Im pretty sure She just has to show up at court.I think thats how that goes cause my mom didnt sign hers and it went thru anyway.I think you contest it if you dont like what they say but you only have a certain amount of time to do that.Have her check with her lawyer.

His not signing is only going to prolong it. She can't force him to sign...but eventually she will get her divorce.
