I am a mother who was sharing a lease with my son who passed away recently, there was four months left on the lease. How can the mother break it legally. We are living in Sparks, Nevada. The landlord want me to pay an extra months rent for breaking the lease. I would be spending money i do not have. So how could i legally break this lease without paying the extra months rent.

I know you want a straight yes or no answer, but that isn't possible. Not without more information. Was the Son's name on the lease? How long was the lease for? How many months do you have left? Has the apartment been rented out to someone else already? If the son is the primary on the lease, then it should automatically be ended. But, if your name is also on the lease, then you are still responsible. Now, I also know that there are several renter's laws that limit the amount the landlord can collect for an apartment. Each state is different, but Nevada does not allow a landlord to collect double rent on an apartment. Meaning, if the apartment is leased out to someone else after you move out but before your original lease is up, then the leasor (landlord) must refund any rent you had paid for the time frame. The downside would still be that you have to pay for the time beforehand, unless it was rented out immediately after you vacated the apartment. You are still responsible for any time that your's or your son's items were in the apartment, and it was not rented or leased to anyone else. That's the only downside of signing a lease.

You can break a lease legally by paying the reletting fee which is usually a part of your monthly rent PLUS the addtnl fee there is till they lease the apt by someone else. The fees just add up. My suggestion is if you don't live on a tax property get someone to sub-lease it (but remember any damages that incur will be your resp) or just tough it out and live there. I know its hard but its better than having it on your credit and any future apts that you might try to get will not work with you.

A way to get out legally is if you are in fear of your life.. which means you have a protective order against someone and they are trying to harm you........

best bet ...stay put!!!!!

Sorry for your loss.

Unfortunately, a death in the family is not a legal reason to break the lease.

The landlord is actually being reasonable.

Legally, you can be held liable for the rent until a replacement tenant is found, as well as any costs the landlord may incur due to your breach, such as advertising costs, agent fees, etc.
