Because it costs money for the judges, administration, paperwork and so on. The party initiating the divorce is usually the one that pays. It is not always the husband; but if the woman's lawyer is good, he will try to get the charges turned over to the man. It is the judge's decision. Even tho I was the one that petitioned for the divorce, and I had a lawyer that asked for the charges to be paid by him, the judge did not grant it and I paid for the divorce.

People pay for their attorney's time, the courts time and the judges time when they get a divorce. It costs money to file all the paperwork necessary to get a divorce.
As for the man always paying that is not true. The person filing for the divorce is the one who ends up paying and it could be the woman.
As for alimony and child support paid by the man to the wife it is usually done that way because usually the man make more money than the woman and the woman usually gets physical custody of the children.
It is not always that way though. When the woman makes a greater salary and she is the one that wants the divorce, then she may be required to pay alimony to the husband. The same would apply if he receives physical custody of the children, then she would pay him child support.
I hope you never have to experience any of this.
Good Luck

A lawyer isn't going to work for free and neither is a judge and then there are court costs, you don't get the courtroom for free, the baliff has to be paid as well as the court reporter, paralegals have to be paid for typing up all of the paperwork. Then of course there is the cost of the paper itself. The husband doesn't ALWAYS have to pay the wife, alimony is not always awarded and when it is it is only because the spouse getting paid has been out of the work force and needs money to live on while looking for work to support themselves on. The other payment would be child support. It takes TWO parents to support a child so of course the husband has to pay support for his child. If he doesn't want to pay child support then he shouldn't unzip his pants, drop his drawers and help create a child.

It's not always the husband who pays. It's the one who files for divorce who pays. And they are paying for attorney's fees, for doing all the paperwork, and for court costs. The spouse who gets custody of the children is the one who gets paid alimony.

It is my understanding that whoever FILES for the divorce is the one who PAYS for it.... and statistically, 60% of divorces are filed by the WOMAN.
Now... as for the SETTLEMENT of the divorce... THERE you have a different issue altogether... and that you are not asking about.

That is not always the case. Usually what happens is whomever makes to most has to pay. They usually pay for things like insurance, child support (if a child is present), I am not sure what all else.
Good Luck!

People have to pay to get married. If it helps, it's not the process you're paying for, it's filing all the paperwork. And men still usually make more.

It depends but it's usually several thousand dollars. It's usually the husband because usually the husband has more money, and the woman doesn't and still needs money to live off of. All of the sudden, she's cut off from her main supply to live. She needs something to live off for a while! If the man is complaining, that's not very nice, or gentleman like.

I took nothing but what I had prior to the marriage and my car. I signed over the house and the little bit of equity. I took all the debt incurred under my name (though I was NOT the one who incurred it, but it was in my name so I was ultimately responsible for it) and I paid for the divorce. $495 non contested.

It all depends on how long you've been married and who is making more $$$$. Children custody and support is also included, you can make ur spouse pay for your lawyer in some states if you file first and you've no funds.
