How should I get my money?

1) Call the person and say I'm getting an estimate and to cut me a check?
2) Call the person's insurance and tell them to write me a check?

Which one? Because if one or the other doesn't happen in then next 5 days, I'm going in for a hospital visit because my "back" is starting to hurt.

Ok, the back thing, unless its legitamate, don't do anything. Seriously get a physical though incase something does come up in the end. If your feeling nice and don't want your insurance to go up (althought alot of brokers have a no fault claim, look yours up) you could call her, they usually don't want their insurance to go up any more as well is are usually willing to pay, if not, definately call your insurance, you should do it right away though.

Personally I'd just call the insurance, theres no guarentee shes going to pay for it and might just keep stalling you and then you won't really be able to have a claim against her.

If you have comprehensive insurance you should get paid from your insurance company, less the deductible (once your insurance co. collects from the other insurance co. you will get the deductible back)

If you only have liability insurance, your insurance co will likely not help and you should go with option 2. And you should NOT wait 5 days to make contact!!!! Do it TODAY!!!!

Contact their insurance company. They are going to be the most responsive. If you have full coverage from your insurance company they may be willing to assist you.

Don't even think about insurance fraud. Could end up with a broken car and end up in jail.

Turn it into your insurance company and let theym handle it. Most states now are no fault states meaning your insurance company will reimburse you and then go after the other person's insurance. You do have insurance, don't you.

#2,plus get the police report and go to the doctor to get chexked out, then let the insurance companies figure it out . Keep on top of it ,it may take longer than you want.

First call your insurance company and make a claim. they will take care of everything...get in contact with her insurance and make sure it gets paid for. if they don't take care of it, call her insurance, but you should really talk to your own company.

Call the person. See if that person will cooperate or not. If that doesn't work call your insurance. That person still needs to cooperate. If that person doesn't, depending on the cost, you might have to go to small claims court.

Depends on your State but I would get a police report and contact your ins co see what they cover and if you have to file a complaint to the courts.
