Okay, our theory is that everyone should be equal, and that criminals should have equal rights to everyone else after they've done their time.
Is there a philosopher who believes that everyone should be equal, and/or that after a person has served their punishment should be treated equally?

It's John Locke. And the philosophical theory is that everyone IS equal, not just should be equal in the eyes of God. However that equality is also contained and legitimized within the canon of law.

Therefore, even though we believe (because of Locke) that even criminals are equal in the eyes of God, we reserve the right to suspend rights granted by law until the criminal has done his time and earned them back.
