I have been working for my current employee for two years now. I would like to file a harassment lawsuit against the company due to fact that my co-worker has been harassing me non stop, in which the company knows about it but, wont do anything due to the fact that she has been on the job for about 19 or 20 years. The president of the company has say things to me like, "dont worry about it", "she's just in a bad mood", "she's having woman problems" (she did have surgery). Nothing but excuses for me to not get upset or take it personally or offensivly. I'm sick of it and really tired of coming to work feeling uncomfortable. Sometimes I would just sit in my office and cry. I think its really bad, that people think they could treat people any kind of way they want and feel they could get away with it. The crazy thing about it, is that she only treats me this way. None of my other co-workers gets the treatment. What steps do I take to file the suit. What type of evidence do I need?

She talks down to me, saying anything under the sun. She speaks to me like I'm a child. At times, she tends to ignore me if I'm calling her or asking a question. She walks up and down the halls in the office talking about you very loudly as if you can't hear her. Funny thing about it, before I came to work for the company, there were six other girls quit. She is very unbearable.

I work for a family owed business. The president of the company, is the son of the father we recently retired. She is just the bookeeper. The president of the company knows everything. At times, he comes to me and apologizes for her actions or doings. My supervisor has said that she is just trying to get me to quit. Push me out. But, I refuse to go without a bang! I won't let her win.

It really depends on the type of harassment. Some types are actionable, while others are not. You really need to find a lawyer who will give you a free consultation, and if necessary take your case on a contingency basis.

contact your local Equal Employment Opportunity Commission and file a complaint. The office will issue you a "right-to-sue" letter (meaning that you have a right to sue the employer) and investigate your complaint. This will not be anonymous. If they find against you, you can still sue but probably have less chance of winning than you would if they found in your favor. For hostile work environment harassment, you need conduct or words on the part of the EMPLOYER, not the person you have the problem with, that are severe or outrageous enough to cause a hostile work environment. You need really specific evidence of you informing them of a problem and them not doing anything about it--document everything you can and write down every conversation you have with your superiors.

Unfortunately, just having a rude or obnoxious co-worker does not qualify as harassment. Is this co-worker being rude and/or harassing to you because of something about you (such as race, gender, age, religion, disability, or sexual orientation?)? If you are not a part of one of these "protected" classes and are not being harassed because of being in one of them, then you have no legal recourse to file a harassment claim. If you think that it does have something to do with it, then contact your local EEO (Equal Employment Opportunity) Office and talk to them, they would be the ones that you would have to file a harassment claim with. If you are able, it would be to your benefit to have an attorney. However, if the business you work for is a small business, it may not have enough employees to be subject to the Federal EEO guidelines, so you may not have a case anyway.

I would first put my complaint in writing to the human resources dept. Try to get a documented response from them. then if that did no good, you need to first contact the Equal Employment Oppoutinity Commision. They will verify that you have a legitimate complaint and will determine if you can file suit. Consult an attorney, though, as I am not an attorney and cannot give legal advise.
As for some of these people answering before me, if you have complained to management about this behavior and they have done nothing, they ARE LIABLE.

But let me say something else, woman to woman. DO NOT under ANY circumstances cry at work. There are NO tears in business. She either is trying to get you to quit for some reason or she has sniffed out someone she thinks is weak and knows you are easy pray. Wipe your **** with her, get your strength on and do your job. Do NOT let anyone push you around and I'll bet you my sub sandwich, she will stop.

You can not file a law suit because someone at work is not nice to you. Yes, your employer can treat you like that. They are no laws protecting anyone from a soft shell. Suck it up or find another job. I just don't see where your lawsuit could come from.

"harassment" is no basis for a suit against your employer unless it is based on some protected classification like sex, race, religion -- what is the nature of the harassment?
edit - you have no case. there is no law against obnoxious co-workers or bosses. If it becomes centered on your gender or race, you may have something - otherwise, you are hosed.

Is dis???? ok sorry I basically don't understand that. besides that's humorous in a foul nasty you will Hell way. Too previous due all of his funds went to charities for grotesque puppets and trolley restoration. i attempted to sue already am emotionally scarred my first call is the comparable as between the scariest puppets on the instruct. i became into tormented as a toddler.

You are the victim of a "hostile work environment." You can call the EEOC. You need to document what this employee said to you and if anyone else witnessed it. You also need to document when you spoke with your boss or human resources, and what they said. Get things in writing if you can. Good luck!
