I divorced my husband some years ago, I am now very happy with someone who has taken on my son and my son has called him dad for the last 4 years. We have a baby son together and now my son who is 8 years old has decided that he would now like to change his name to be the same as his brother and dad, but I need to know what I have to do to have this done legally.

the same thing happened to me i changed my sons name by deed pole you don't need the fathers permission and it is a legal name change. if your partner wants to adopt your child when it all goes through his name will be changed to your partners but this will need the fathers permission

Where do you live? People need to state that when they ask legal questions because that’s very important information.

The poll deed thing applies only in the UK (and I know nothing about how it works).

If you live in the US, you have to petition the court for a name change. Dad has to be notified. If Dad contests the name change (and he doesn’t have to give a reason why), it won’t happen. Even if Dad doesn’t contest it, if he doesn’t agree, then it still might not happen, especially if he’s a part of the child’s life, and being a part of the child’s life does not necessarily mean having physical contact…it can be as simple as him paying child support (even if it’s sporadic and he only pays it because the court makes him).

FYI—in the US, Dad does not have relinquish his parental rights for this, and step-dad does not have to legally adopt the child either.

In order for you child to do this, your husband will have to legally adopt him..When you start the procedure, your sons biological father will have to contacted and he will have to legally give up any rights to his son.. Do you think he will do this. Of so, get in touch with an attorney and tell him what you want done. I'm, not real sure as to how much it will cost but it will well be worth it to the child..Do you receive child support from your sons father? If so, it is going to be difficult to get him to give his parental rights. A lawyer can explain all this better than I can...Good luck to ya and I hope things turn out good for you and your family.

You can do this through the courts.. just call the courthouse and ask. They will direct you to the proper department.

You need to get the son's father's permission, if he is in the picture.

You also have to go to social security and change your son's name, once you have the legal documents.

My mother did this some years ago and it was $400 in her State (1995). It's costly.

It can be done legally and usually without any documentation for children under 16, however you may need your ex's permission to change his name. This is usually circumvented if your ex doesnt have any contact with your little one.

Speak to the CAB or a solicitor.

i was in the same situation,both my boys took on my new husbands name,we haven't yet changed by depoll,but will,changed their names at school and Dr's,etc,my son just received his N.I number in his new name,hope this helps,good luck.just read some more of the answers,you don' always need ex's permission if not been in recent contact,the judge would say child does not have right to name.

It is done by deed pole.
Ask someone more proffesional but i think its pretty simple.
A similar thing happened with afriend of mine. Her husband changed his name at the age of 26! So you'll have no problem as oyur son is only eight.

Your son's biological father has to give up his rights in order for you to change your sons name

Im pretty sure you have to go through the courts to do this.Just call your local court house and ask how you can do it.
