I am a single mother and my daughter is going on 4 years old. Her dad is not in her life nor would I want him to really be. He walked out of her life when we split when she was only a year and 1/2 and has never looked back. He does nothing to support her and has no finacial stability at all. He bounces from place to place living off of other people. He's in and out of jail, lies, cheats, steals and is just not someone I would want to have much influence on my child...I mean our child. He' a con-artist, nothing more, nothing less.

Anyway I was just wondering what I can do to ensure my daughter goes to my parents, sister or a close friend if something were to happen to me. What do I need to do?

In the will I included the reasons why my son SHOULD NOT go to his father and in the event of my untimely death his guardians should be my parents and if they were not around then my brother. Here is one problem though. In my state, this would not hold up in court if he has attempted to see his son and I refused to allow him to see him. Additionally, I would have needed to prove he abandoned his parental responsibilities for at least 6 months or more. My son just turned 4 in June so I am out of the woods heaven forbid something were to happen to me. You really need to sit with an attorney and draw up a will. I know it can hurt the pocket a bit, but it was so well worth it and I was able to finally sleep at night.

Unless he signs away his parental rights, he can (and probably will) get custody of her upon your death. I suggest you hire an attorney to terminate his parental rights. Also, you should make a will that provides for the care of your daughter! Go see an attorney. It can be done rather cheaply.
