Unfortunately, you're out of luck. You can't sue him, and you didn't get a contract in writing. If you want to do business with Indian outsourcers, you need to get a written contract from them AND make them get a business liability insurance policy with an insurance company in England or the US. Have them show you the policy (scan it) and call the insurance company to verify that they are underwriting his company. Because even with a contract - if you try to sue them, there's no way to enforce a judgment. India will not go after scam people on their soil just because someone in another country won a judgment, so the insurance policy pays you damages if the Indian company won't deliver and you successfully sue them in a US court. The insurance companies have their own way of settling disputed claims levied against their Indian clients, so it wouldn't be YOUR problem. But you MUST make them have both a contract AND a valid business liability insurance policy on a British or American Underwriter..
Unless you can talk this guy into giving you the money back, you have lost it for good. Only thing you can do is write a review of him online to let other people know about him and not to make the same mistake.
