The fourth amendment. It says that searches may only be performed with a warrant, and to get a warrant you need 'probable cause'.

The warrant must also describe exactly what the police are looking for, it can't be just a 'fishing expedition'. And the search must be limited to that item. For instance if they're searching your house because they think you stole a grand piano, and a cop opens a drawer and finds dope, that evidence is not usable in court because the cop had no reason to believe the grand piano was in that drawer.

A couple of years ago the Supreme Court basically invalidated the 4th amendment by deciding that evidence was usable no matter how it was collected so long as the cop says he sincerely believed there was a crime involved. The cop doesn't have to specify the crime or give any reason why he thought there was a crime.

As others have said, it's the Fourth. But the police don't always need your permission to go through your stuff, although if you give it you're screwed.

Read the Bill Of Rights. Know it. Each amendment is about ONE SENTENCE. They are short, and sweet, so common man and woman can read and understand.
