4) If he's trying to break into your house, he's committing attempted burglary.
5) If he actually breaks into your home, you can shoot him.

I suspect you mean the 'someone' to be the Police because it is illegal for anyone else to kick down your door at night or any other time. Some police departments allow warrants to be served at night. Most departments don't like to do that because of the increased chance that someone may get shot and will do a nighttime warrant serve only as a last resort.
Most will do the warrant serve at dawn or just after because there's better light and the police are pretty sure the suspects are fast asleep in dream land.
I'm no police officer but seems to me they do it that way most often on Cops and the different SWAT shows. I might be wrong.
