If you're referring to the Alien and Sedition Act of 1798, yes -- the first amendment was ratified in 1791 -- however challenges to the Act never made it to the Supreme Court.

It was, and that is why the alien and sedition act was eventually done away with. It violated freedom of speech, and many other constitutional rights.

Yes, the 1st Amendment (along with the other 9 of the 12 proposed at the time) was already ratified.

That's one reason the law was declared unconstitutional.
