Hey guys. My roommate got arrested for possession of a stolen tricycle last night. He was bailed out this morning out of the local county jail. He does have a court date at the end of the month. My question is, can the school turn around and say "we don't want you here anymore"? And if so, how long does he have to wait?

Today is Sunday, so I'm assuming college offices are closed for the weekend. What do you think the college will do to him?

I doubt the college will do anything to him.

The school can take its own actions against him independent of what the courts do. In most cases like this, the school waits until the court determines guilt so they can not be sued for taking action prematurely.

In the case of the Duke University boys, the boys now have an excellent lawsuit against Duke for its actions prior to the court finding any guilt. Each of the boys will probably get a million or two from the college.

Tricycle? It would depend on the crime, your college rules & state rules. (Unless of course, your last name is Bush)

It all depends. As of today, Sunday, he is as innocent as you and I to the crime and will remain innocent until his trial.
