DNA evidence has done wondrous things in recent years to help convict rapists, and to free innocent men wrongly imprisoned due to false or incorrect claims.

The more troublesome issues arise in so-called date rape cases where the two parties knew each other and the issue isn't the identity of the person accused but rather whether the women gave consent. This comes down to credibility since there are no other witnesses. The stakes for the male are enormous -- they are often college boys, and they run the risk of being put away for decades, twenty or forty years, then having to register as a sex offender for the rest of their lives. Even trickier is the question of whether a woman who initially consented or even initated sex withdraws consent after the act has started. Sadly it may come down to which of the two is a better liar. What if she lied and his life is ruined because she wanted to hurt him? It happens.

It is for this reason that everyone needs to be presumed innoent of any crime. Some women do lie about rape. The former head of the Manhattan sex unit (a woman) said that there are 4,000 claims of rape every year in Manhattan, and of those, half did not occur. Stats are hard to reconcile, but the fact that some women do lie about rape should not be controversial. Regardless of gender, people lie about everything imaginable for all manner of reasons. The claim by some radical feminists, however, that women don't lie about rape defies common sense, and is not supported by the evidence. Tell me why, in the singular instance of rape as opposed to every other subject that arises in the course of human events, mirabile dictu, one gender is wholly incapable of telling a lie while the other is composed entirely of pathological liars?

This is exactly what happened in the Duke lacrosse non-rape case, and the lying accuser put three young guys and their families through hell for a year. That's why the justice system needs to be so careful because, as we learned in law school, it is better to set 100 guilty men free than to convict one innocent man. That goes for rape and every other crime.

If she has been raped there should be physical evidence since she wasnt excited and therefore not moisty. In America unlike what Tera said you do NOT have to proove that you have been raped. Ripped undies semen those are not signs of rape. All you have to do is to convince the jury and for the jury there is no proven untill innocent guilty. Who presents the better sob story usually wins.

Unfortunately, women who claim to be raped often have to go through very highly embarrassing personal inquiry and sometimes invasive medical tests to "prove" they were raped. I know this from personal experience. I had to go to the police station and underwent an hour and a half of (for me traumatic and emotional) interrogation about the specific details of what had happened. I had to explain in graphic detail every single thing he did to me, exactly what parts of his body touched me where, and so forth. The police didn't just automatically "assume" I was telling them the truth- they grilled me for a long time about whether or not I had at any point given my consent (directly, indirectly, or implied) to sex. When I reported the attempted rape the police collected my ripped undergarments and put them in a sealed plastic bag for evidence. If you've never had to take off your undergarments and hand them over to a stranger for inspection, let me tell you, it's not a grand experience. And you know that if the case goes to trial, the jurors all be passing these things around, inspecting them, too. If the rape had not been only an attempt, and it had actually been completed, I would probably have been asked to undergo medical testing for the presence of semen in my vagina, and if found, a sample of it would have been collected and DNA testing would have been performed. Of course a woman can refuse such tests, but to do so may cause a lack of physical evidence (esp. if there were no witnesses, no confession from the assailant, etc.), and this lack of physical evidence would make it difficult to successfully prosecute the perpetrator in a court of law. The people in this forum who are saying that "all a woman has to do is claim rape and that's enough to successfully prosecute a man for rape" are wrong. It's not enough. Even women who put themselves through testifying in court (and many women are reluctant to even do even that) aren't guaranteed a verdict in their favor. Depending on the charge, oral testimony isn't always considered enough evidence in and of itself. Many rapists get away with their crimes. I'd venture to say that most never even get charged. And most women would never lie about being raped. Who would want to go through what they would have to go through to prove that it really happened?

there have been cases where women have made false claims about rape. its difficult for a man if he did have sex with her to prove he didn't rape her i feel sorry for those guys.

She just has to claim rape. The difficult thing is a man proving he didnt rape a woman.
Edit: why the thumbs down? it is a fact that women can easily get away with rape claims, or at least it is easier for a woman to claim rape than for a man to defend himself against a false accusation! This reaaally hurts feminism´s credibility.

There would have to be medical evidence, such as injuries, for one thing.

Oh, and Tera--they DO have to make sure they're not going to falsely accuse someone. They can't just take your word for it. Innocent until PROVEN guilty.

Women shouldn't have to PROVE they've been raped, they should be believed. PERIOD.


In response to your e-mail-typical, typical answer by another insensitive male. Rape is a devastating occurrence, very hard to "fake it", especially the emotional devastation. Plus, there are medical, physical signs as well.
