I have applied at a college and when they did my background check, an arrest for Assault showed up. I was not guilty, and the charges were dismissed from the judge. The school is investigating this further but since they already offered me the job with a letter, since I am innocent and was only arrested, is it illegal if they take back their job offer????

They should at the least ask you for 'your side of the story'. Employers (especially government and !!SCHOOLS!!) can and usually are held responsible for background checks on their employee's. If, such as in a case of physical violence, comes up on your record, an arrest report is all that is needed to rebuke an offer of employment.

Since the charges were dropped it should not even show up on your record. If you were actually convicted they would be able to refuse you a job. You have to remember that they have the safety of thousands of students to think of. They have to be careful of who they hire.

It is not illegal. It is not discrimination.
I would though, present all evidence of your being cleared of charges to whomever is the Human Resources represenitive of the college.
If you were proven innocent in court, the college probably just wants proof in document form.

Generally no, but a college might have a written policy regarding this, and that may be why they are reconsidering.
"innocent until proven guilty" and all - if anyone is likely ot listen to that reasoning, a college would be :)

Federal, and most state, employment laws prohibit discrimination on the basis of race, sex, age, nationality, religion, marital status, sexual orientation, and physical handicap. It would appear that arrestees are not among the class of people protected by anti discrimination employment laws.

They can refuse to hire you based on charactar. Even being innocent it is their call and they can question how you got into that situation.

They can refuse to hire you for any reason as lon as it isn't based upon race, gender, religion or sexual orientation.
