Yes, it is illegal. The only reason he could get away with it is if he had Power of Attorney from YOU! Even then, I do believe that he would have to sign his own name & not be forging yours. What did he do with the money? If he can't or won't tell you, then you need to call the Police or the District Attorneys Office. You should also contact your bank & get a copy of the forged check. You need to speak to a Lawyer about what you should do first because your life just COULD be in danger from this man who seems to have something up his sleeve! Please protect yourself first, then protect your money second. If you have a joint account, then the Lawyer can advise you if it should be closed. You need to find out where that money is & depending on your instincts & history with this man, you just may have to treat him the same as you would any other criminal & start the process of pressing charges on him or file with the people who cashed the forged check & have them re-issue a check to YOU & let them go after him. The problem is that if you are married, then you could be held accountable for the loss/overpayment if another check were to be issued to you. That's why you should speak to someone who knows the law before you get in any deeper. I take it your husband isn't cooperating with you, so your next move should be a carefully thought out one so that you can avoid becoming another statistic of domestic violence. A man like this does not have your best interest in mind...he just wants what he wants & feels as if he is entitled to it because you are his "wife". Please be smart about this & when you do get your money...get as far away from him as you possibly can afford to separate yourself. Good luck & be safe.

yes--and if that was life insurance you should report it without telling your husband what you're doing.

Whatever it is, I'd be suspicious. He would be upset if you had done the same.

And this is just a couple that you're aware of. I wouldn't confront him, I'd look into it and other possible forgery that he may have done, and get free legal advice and pursue it.

Just because he's your husband doesn't make him less of a criminal--seriously.

Yes.

Are you the one being insured? If you die, who gets the money? How much was the check for? Go to the bank and contest the forged signature.

Are you safe around your husband?

You need to call the insurance company right away and also file a police report. NO ONE can legally sign your name unless power of attorney is given. It's up to you, you have a case and he can be made to give you that money. Call insurance fraud line, and also the police.

Unless you have given him Power of Attorney, signing YOUR name is a crime. Whoever said it is legal in some states if he signed 'by his name' is WRONG. That ONLY applies if he has a Power of Attorney' or other LEGAL authority to act in your name. The fact you are married NEVER conveys such authority.

Yes, it's illegal & you are the only one who can press charges is what I was told when this happened to me. If he isn't willing to cooperate or explain his actions, then I don't think he has your best interest in mind & doesn't value or respect your marriage. You may want to think about leaving this guy? Ask him why he didn't tell you & where the money is? Sounds fishy to me though.

Call the district attorney's office, call the insurance fraud line, and call a divorce attorney. Call the state police if local police say they can't help you-it happens, I have been there. The district attorney and state police can both tell you how best to proceed.
