If a girl has decided that she wants a divorce and freedom, how does she move? contact the advocate first? which is the shortest way out? some say it takes 1 yr of separation before u file a case?? some say for a girl who wants a divorce it is easier and quicker..all too confusing..some one pl advise..

The best way out for any one in India with regard to dissolution of marriage is divorce by mutual consent, in this both the spouse file a joint petition for divorce in the family court & pray their marriage may be dissolved by the decree of divorce. In this case they should have been married for one year & should have been living separately for at least one year. What it means no decree of divorce in the first year of marriage. Next way out for divorce by any of the spouse is to cover his or her case under the any of the various reasons for divorce which are provided under the matrimonial law under which they got married & seek the dissolution of their marriage. These can be any of these such as cruelty, desertion of two years or more, adultery etc in such cases the divorce is contested by the other spouse & it may take long time to decide which may vary from many months to many years. In case the divorce petition of any of the spouse is not contested by the other, it may get decided ex-patre & it will not take such long time to decide. Where as the divorce by mutual consent which is not at all contested & it may be decided anytime between six to eighteen months time period. So the best, easiest & quickest way to dissolve any marriage is when both the spouse decide to end this relationship by divorce by mutual contest.

1. You could go for annulment of your marriage if it is within 1 year of your marriage. the marriage has to be either void or voidable for you to go for a decree of nullity. if your husband / you agree not to contest and if you have a ground of force, or fraud or of sexual impotency of either you or your husband you can end your marriage before 1 year.

2. After 1 year of separation you can go for divorce by mutual consent which takes 6 months ( sometimes maybe upto 18 months ) to settle.

You cannot do all these things on your own. You need an advocate, get in touch with an advocate known to your family.

yes its always better to contact a good advocate first so that he can know u r situation and the reason for divorce and that is the best way to proceed as we dont know the abc of the reason behind it u will not get a satisfying answer here and it will be a waste of time for u too.

Many in India remain unhappily married, because if divorced, the entire family, his and yours, will drag you through the mud, disown you, or even stone you to death.

The man doesn't get the same treatment. It's always the wife's fault because she didn't do what it takes to keep him happy.

if you want the divorce, do it, but be ready to start a new life, far, far away....

You will want to obtain legal advice from a local court or attorney, different countries, different rules...

If it is mutual concern it is easy for both of them , to apply for a divorce within six months. If one party is not accepting the problem starts. It is better to have one to one counselling and come for mutual concern and then apply together to get a separation. Now days many applications are coming Yours VRVRAO

if u want divorce from ur husband first of all give all necessary informations to advise u in a proper manner to avoide confussions.

without divorse, u can live free. apply to court thru advocate
