1) No. As situations develop, there is a point of no return at which people go into the "fight or flight" stage. The key to conflict resolution is to recognize developing situations early and de-escalate before the situation gets out of control.

2) From a legal standpoint, always. Anytime a situation becomes violent, it is certain that litigation will ensue. Even if one is eventually cleared of any charges, these incidents become a part of one's personal record - or negative press coverage if a business is involved. If not cleared, sentences could range anywhere from fines to job loss to imprisonment.
