I want to file a workers comp for my burns that happened when a scalding glass filled with water that was 170 degrees was tilted over my hand by another employee. The thing is, I am a heavy weed smoker, but i wasn't high at that time, i don't do it at work. But will they have me take a drug test, and i come up positive for marijuana, will I get fired from the job as well as being denied workers comp?

You can go to a pipe shop near you and purchase Detox.
Just ask the clerk for it, or something to clean your system.
It usually runs about $50, but it works fantastically. You can even do it the same day.

I suggest drinking nothing but water 2 or 3 days before-hand, then taking the detox as directed.

But if you still have a week, all you need to do is drink plenty of water, your know, eight 8oz. glasses a day.
And work out a lot.

Depends. If you file for comp then the companies insurance company will be involved. They may require a drug test. In this day and age many companies themselves require it in order to file a claim.

Here's the thing. It does not matter if you do it at work or not. Everybody knows that you smoke as it is always obvious, regardless of what you think. So odds are if you file they will test you at some point. If you test positive they will have to fire you for insurance reasons and such.

So just tough it out if you want to keep the job.

You can get fired and screw up a workmans comp case if you had drugs in your system at the time, but how long has it been? Why would they have you take a drug test? is that the policy where you work? If it is, pot stays in they system for at least 30 days. When i fill out workmans comp papers for employees, one of the questions is do you think drugs or alcohol were involved. If i choose yes, then you will get a toxic screening and if i put no you will not....Its all according to your company policy..As i said if the policy is drug testing after an accident then yes you will be in trouble and prob. denied

How bad could your burns be?

No way in heck would I file comp for this if you know for sure you are going to fail the drug test. They will 1. Fire you, 2. deny your claim based on your breaking the law and violating company policy.

Go to your regular doctor and get it taken care of. But go to work.

Reality sucks sometimes

The company may have a policy in effect that forces you to submit to drug testing in the event of an injury suffered on the job. Also, their insurance company may require it, either way you may have to submit to a whiz quiz. You may have your claim denied and/or be terminated.

Many places now require a drug test in the event of a WC injury,
If positive, they could challenge your claim, stating you were under the influenmce and also fire you.
Was it worth it???????
