It doesn't matter if the charges are dismissed or not. As long as the accused shows up for all his court appointments and doesn't leave town, then you'll get the money back. It's kind of like collateral on a loan. If you don't repay a loan then the bank can take your collateral. If you don't show up for court, then the court can take your bail. -yk

You will only receive money back if the amount of your bail exceeds the fines and court costs you are required to pay when your case comes to trial. This is not likely, but it can sometimes happen if you can argue your case down to a lower offense or if your manage to win your case.
In all jurisdictions I have ever heard about, the bail money can not be released until all fines and court costs are paid in full. Then it can either be paid out in cash immediately or be paid in the form of a check. This will depend on the rules of the court you were in.

Bondsman don't work for free, that is the fee for doing the bond and taking the risk. But unlike what some of the above have said, if you HAD paid the 5000 it is very likely you may not get any of that back (the judge will try to justify it as court costs and fees) Also, when a bondsman hires a bounty hunter or does it himself, he does NOT go after the person that posted the bond, he goes after the defendant. But he will probably charge you for having to go get the guy as well, so never bond someone out unless your willing to pay the full amount should he decide to skip town.

You get the bail money back if you don't skip. If you are innocent or convicted, you still get your bail money returned. Bail is just insurance that you will go to court and not bolt. Forfeiting bail money if you lose is paying a fine not given by the court and is illegal.
Money to a bailbondsman is lost forever into his or her pocket, however.

You usually get the money back when the trial is over and the person is either found innocent or he is found guilty and must go to jail.
The purpose of bail is to make sure the person shows up for court.

If you post cash (pay the entire amount directly to the court), then you receive it back when either the person is acquited (found not guilty) or begins serving a sentence (after being convicted).
If you post bond (pay a bail bondsman), you do not get your money back.
You also do not get your money back if the person does not show up for court.

You may once the court matter is litigated. Bail, however, is often held over for fines or restitution. Get a written promise from the person to pay it back before you post it because you may never see it again.

If you go through an licensed bail-bonds agent, then no. If you simply post it yourself you will get it back provided the person in question makes their court dates.
