ok on june 8th 2007 i was working for a race tack and got burnt really bad. i was only 15 years old and they had me working a huge gas grill, one of the uge barbecue grills. my boss lit the grill and turned the gas up. then he shut the lid, i went out 10 minutes to check on the burgers and i noticed the flame went out. so i shut the lid and went in and got a lighter to light it. when i lit it, the grill blew up because of all the gas built up inside of the grill. i was in the hospital burn unit for 1 day and have scars from it. should i sue? also i have pictures if u would like to see them.

it is against the law for a 15 year old to work the grill, workmans comp gave me 500 hundred dollars and is now saying i owe then 300. what do i do

1) You didn't seem to have a problem with being underage and operating the grill before anything happened -- you really can't use that as leverage, because by your own admission you were an accomplice in the illegal activity in the first place (you obviously knew you weren't supposed to be doing that particular work beforehand, and therefore, any malfeasance you are trying to place on your employers falls equally on you).

2) All jobs have occupational risks ... even office jobs where you just enter data all day. If I were the attorney on the defense I'd ask you why you didn't check the gas setting before you tried to light it ... Seems to me that your actions were equally culpable as those of your employer, and you share the negligence in your injury. In order to win a case you have to prove that either your employer acted with malice aforethought (meaning he purposely planned on hurting you), or that your injuries are a result of gross negligence on his part. And, from what you're saying, neither of these are the case ... so you have no case.

When will people in the United States stop finding reason to blame people for their own mistakes, and/or accidents ... that is why they are called accidents, because no one means for them to happen. But, no .... American culture has degenerated to the point where everyone has this visceral need to say "No ... he/she meant to do that ... and I'm mad something bad happened to me, so I have to blame someone for it."

I'm sorry you got burned, and I hope you learned a valuable lesson from all this, but I don't think you have much of a case, and, in all honesty, I think you have this little thing called 'victim mentality.'

you should be covered under Workmen's Comp and may not be able to sue your employer (you were working "on the books" I assume)

thats what happens when under age kids go out to work,somthing happens and you dont have a leg to stand on,you were under age
