My friend and I want to move in an apartment. But the thing is, is that I have bad credit and I know I wont get approved. But I'am currently working on it to get it fixed, but it's going to take a long time, and I really need to move and get an apartment becaues I'm finishing college and its far from home. Anyways shes fine with having it under her name, and I know u cant do that. BUt would they really be checking the apartments for people that arnt suppose to be there? Its a really big apt complex. Just need some opionion cuz I dont want her to get into any trouble.

There are two issues in this arrangement.

First, if your name is not on the lease, you have no _rights_ to be there. Now, that doesn't mean you can't be there if the person on the lease agrees with you. What it does mean; however, is that if she decides you have to move out, you do have to move out. You have no rights under any laws to be there so you are not protected.

Second, having your name in the lease as a renter and having your name in the lease as a person who is living there with the lease holder are two different things. Living there without knowledge of the apartment manager will make you a "temporay" guest. Usually, lease has 7 day or so limit for these people. This is to prevent EXACTLY what you are doing - person they don't know living there without their knowledge. What you want to do is, to have your friend declear you as a person who can rightfully be there, but not as a person who is co-responsible for the rent. Otherwise, both of you can be evicted for violation of the rental agreement.

Exactly, how did your credit go down the toilet? Hmmm, could it be that you once were roommates and someone stiffed you on the rent?

Why would it take you a long time to fix? Do you know the difference between "want" and "need" as in "need to move" v "want to move"?

Now your roommate sound like a total financial airhead to let you squat in the apartment (most likely in violation to one of the first 3 paragraphs of her lease) or there is something else going on.

Surely, a college student can find a legal solution to this:

Make a budget and adhere to it. Drop the boyfriend/hook-up whatever for they will only cost you money --- which you do not have. Get a respectable job that pays wages (not in experience or future contacts). Eat less, buy less clothes, avoid Victoria Secrets. you do not need make-up (soap, shampoo, tampons, yes, --- lipstick, perfume, etc NO)

Study hard and remember --- you are responsible for you. The secret of Women's Liberation --- Is to be free, independent, and RESPONSIBLE individuals who just happen by God's good fortune to be female. Stop being a wimp.

Most apartment managers require anyone over 18 living at the apartment to be on the lease.

Even though you have bad credit, they will qualify you together. Your friends good credit may even out your bad credit. If you move in and you are not on the lease, you could be told to move out because you are not on the lease.

First, do not assume you will not get accepted. Plenty of people have bad credit and find apts. to rent. There are catches though. I know someone with bad credit and she had no problem getting into the apt. she wanted BUT they tripled her security deposit (from $600 to $1800) due to her credit history. Instead of raising your security, landlords or management companies may ask for you to have a cosigner (usually parent). I know someone in college with bad credit who got into the apt. complex she wanted by having her dad cosign for her. Because you're fresh from college, the landlord will probably be okay with this.

And finally, they may not ask for credit checks from both of you. In college I lived in a 3 bedroom apt. with 2 friends and even though all our names were on the lease, the management company only required one credit check.

Unless he's a slumlord every landlord will check your credit.
That doesn't mean you can't move in. Your friend can sign the lease and be fully respsonable. It's best to be up front and tell the landlord you'll be living there. It's pretty hard to have to sneak in and out of your own apartment.
