Are you really surprised or think this is definitely a situation where a lawsuit should occur? I think the neglience the school showed in not informing people and shutting down definitely put people in harm's way.

It is possible that "not informing people and [not] shutting down" may have contributed to the disaster at Viriginia Tech, but I think we need to explore a bigger potential problem.

The killer was known to have psychological disorders and to have been disruptive, but nothing was done to remove him from the academic setting? Why not?

I suspect that it was because he was an Asian, and as such, one of the favored class of minorities. Do you think that a white person with his disruptive behavior pattern would have been tolerated?

If they had removed the mentally troubled Asian, their minority percentage would have gone down, and the liberal, left-wing academic kooks who run the institution would have had a fit.

This sort of racism in our academic institutions is prevalent and needs to be investigated and stopped, and those responsible need to be fired or prosecuted or both.

Another example:

I am a lawyer. I hold an LL.M. degree, and I am admitted (by examination) in three states. Yet, when I applied for an adjunct professor position at a University law school in Arizona, they asked me to "voluntarily" complete their racial and ethnic survey form. When I did not, I heard nothing further from them.

What better evidence do you need to conclude that the institution is racist? If they are so interested in what race I am, why not call me in for an interview and find out that way? Since they raise the issue before they even meet me, I conclude that they make their decisions based on race, and that is immoral, and in my view, illegal.

The blatant favoristism shown to the non-white races, at the expense of white people, may have caused the deaths of the Virginia Tech students. If the killer had been white, he probably would have been removed from class long before the incident occur.

its the mind set of the country, sue,sue,sue. maybe it can bring about some change, but you know how slow they are with that. how long has it been since the columbine incident? what did they say they were going to do then? in california they want you to get liability for your child to be at school, obviously to protect the schools behind. solution teach your child at home and let the goverment pay. with all the resources out there you can do it. you heard that the governor wants to take the so-call money from the school lottery to pay for the deficit they are in. the schools were only getting 34% and they are pocketing the rest.

People are just sue happy.
How about bringing a lawsuit against the guys family who shot up the place instead of the school? They knew their kid was a nut, and yet they did nothing about it.

There is always a possibility of a lawsuit. The school could be sued for what you suggested, or for not having a viable plan in place. It could also be sued for preventing students from using their constitutional right to carry firearms, which might have prevented a lot of the murders. Apparently there were the obvious signs of danger emanating from the killer, but no one saw, or reported it to the school.

I personally think its frivolous. The school needs to be spending money on developing safety plans not on court costs. No school is prepared for the disaster that Tech saw. The people that knew him and saw warning signs and didn't raise a flag have to live with that the rest of their lives. To me that is punishment enough.

Face it...anyone can sue for anything...this case simplely has some merit (depending on who's suing who)
