sign the lease or if anything goes wrong is the other tenant responseable for going after said person for restituion

Doubtful. The lease holder, the person who signed the lease, would be responsible and then would most likely have a legal right to go after the person who did the damage.

The person occupying and not part of the lease can not be held responsible by the owner of the property.
However the renter who signed the lease with the owner of the property can be.
You are a tenant to the renter of the property and even though you do not have a signed lease that tenant who signed the lease and is your landlord can hold you responsible, assuming that that tenant has the right to sublease the property from the property owner, who is their landlord. All of you must behave and provide notices in accordance to your state's landlord tenant act since regardless of what is on the leases or in the abscense of lease agreement such laws will govern.

Depends on the lease agreement- My lease states I am responsible for my guests, my children, and all people who are at my house... so if it is just an occupant, I am still responsible for their actions..

If i get evicted though, It will be 100% on my name since I am the only lease holder. Although, if you have a co-signer or another adult on the lease, then it goes on both names!

The person who signs the lease, is the one responsible for any damages, or charges resulting from misuse of the property. It is up to the signer of the lease, to collect from any person or persons incurring any further costs associated with the apartment.
