my brother worked in a hotel this summer, cleaning rooms.and then he found a cheque worth 200$, in one of the rooms he was cleaning.. he went to the bank and was given the money.. but now the manager of the hotel tracked him down ( it appears to have been his)..besides returning the money to the manager, which my brother already did..can this issue lead to court?thanks.

Probably not but if he wasn't fired yet then he probably won't be.That's the worst I could come up with.

If the Manager or bank reports the matter to the police he could be charged with something along the lines of theft, fraud or obtaining financial advantage through deception (this will depend on what the statutes consider cashing a cheque that belongs to someone else where your brother works). If charged he would probably have to go to court.
Apart from that - the Manager may decide that your brother is not of good character and dismiss him. In a hotel it is important to have staff who are honest and have the utmost integrity. You can't have staff who go about keeping things they find. Imagine if your brother nicked something that belonged to one of the hotel guests - the reputation of the hotel could be damaged beyond repair.

Lemme get this straight-- - your brother knowingly cashed a check that was not his ....he presented himself as someone other than who he actually is to a financial institution.

So...he stole the check, defrauded the bank and stole the identity of the rightful owner of the check......nah....that's totally legal ....

If the owner of the check did not go to the police he's fine - if the manager went to the police he can be criminally prosecuted. He could also be sued by the manager (yes even though he gave the money back) in civil court. He may still be subject to punitive fines as well.

If the manager presses charges then it can and will lead to court and if already returned the money he might get some type of break.

If the manager decides to file charges yeah, he could get some jail time, if he has been busted before. If he's been a good boy until now. Maybe probation.

If the manager wants to press it, it is fraud. There are a lot of people in prison for check fraud and for women in prison it is one of the leading causes. Check fraud is no joke.
