I know NY, CT, & NJ it is illegal to talk on your cell phone without a handfree, even though too many drivers still do it. Many other states & communities are trying to pass laws banning the use of hand held cell phones. Emergency calls in many locations are exempt from the hand held ban.

A number of states have varying restrictions on the use of cell phones while driving, but in none of them is it illegal to talk on your phone while in your car.

Example, in New York, only hands-free cellphones are permitted to be used when driving.
