I have worked for a company for about 10 years now. I started working there since I was 18. Through the years I have worked my way up the ranks. Recenlty two key employees were let go due to down sizing. Those two employees started their own business and started competing againt our company. Now, they want me to sign a non-compete agreement. I do not want to sign because If I ever let go I would want to do this type of work. I am very familiar with the industry and I know I would do quite well. Do I have to sign? If I do not sign, what will happen? Will I get fired?

I live in MA. I worked as the district manager for a national staffing service called Marathon Staffing. I signed a non-compete agreement. During that position I staffed Rn's for a home care company and when I left and went to work for that company as their full time recruiter and the company ceased dealing with Marathon they tried to sue me. I brought the contract to Marathon and brought in the existing business that they had so I was deemed in the right with no repercussions.

I suggest that you ask for a few days or even a week to think about it and contact your states labor office and get some legitimate answers for CA.

you have 2 choices, sign or don't sign. If you sign then your legally bound by this contract. If you don't sign don't be surprised to find that in the near tern the company may find they no longer need or require your services.
