My fiance'e was married for 10yrs, but divorced in PA 5 years ago. And we'd like to get married , but he doesn't have a copy of his Divorce Decree (he's lived out of country for the last 4yrs). We want to marry next month... how does he get a copy of his Divorce Decree and what needs to be done to get it? Is a month long enough?

Why does he need a copy of his divorce decree to get married??? No, you don't need that. It is good to have in your personal file, but you can get married any time you want. He just needs to call the family court in the state/city he was divorced in and they can help him, but who in the world told you that you had to have that to marry again???

It depends on how fast the clerk wants to work getting a copy of the divorce decree around. The decree should be registered in the county in which it was originally filed. Only if your LUCKY will the copy of the decree come in a month.

He should have gotten a final decree IF he did indeed get a divorce. It doesn't matter tha he has lived out of the country for the last 4 years, if ANYONE knew his address he would have gotten one. The first thing YOU need to ask is was he ever served with divorce papers or was he the one to file? If HE didn't file and HE didn't receive divorce papers then HE isn't divorced and you won't find a final decree. Frankly I wouldn't trust him. IF he were divorced he WOULD have proof.

Go to, call, or write the clerk or court in the county where his divorce was and get a certified copy of the divorce decree. It may cost $10.00 or $25.00

He has to contact the Courthouse in the County where the divorce was filed. Then he can either request it online or ask them to mail him the request form and then fill it out and return it with whatever fee they charge. And it will probably take longer than a month. But if you are going to be together forever, another month is nothing.

He has to write to the Register of Wills and ask for a certified copy- check out the website for the county he received his divorce in, they usually have exact instructions and fees (usually not more than $10). We got my husband's in a matter of a week, but I am sure it varies by county.

Uhm my lawyer has a copy at her office in which she photocopied one for me. Ask him to visit his old lawyer in which it was filed. If not, the court house/city hall should have a record and may copy one for a small fee.
