YES A COUPLE DAYS AGO...WE WERE AT A FRIENDS HOUSE. THERE WAS A GUY WHOS TRUCK WAS PARKED INFRONT OF A CAMARO. WHICH HE DIDNT C WHEN HE WAS PULLING OUT.. ON DA OTHER HAND HE WAS REALLY DRUNK. HE SPINNED OUT AND HIT HER CAMARO. WELL...THE POLICE CAME DOWN AND GAVE HIM A DUI OFFENSE. BUT THEN I THOUGHT THEY COULDNT GIVE U ONE B/C IT WAS O PRIVATE PROPERTY. WAS THAT POSSIBLE OR DOES IT DEPEND ON WHAT THE GIRL DECIDED TO DO ABOUT HER CAMARO. PLEASE GIVE ME SUM ADVICE B/C HE IS TRYING TO ARGUE THAT THEY CANT GIVE HIM A DUI FOR THAT. THNZ

Most states in the US have provisions in their DUI/DWI laws which cover all driving. Even the ones which don't do have provisions for causing an accident when driving drunk.

Answer me this: Was he driving? And was he under the influence of alcohol? If the answer to both of those questions is "yes", then he can be arrested for it. Honestly, even if the girl didn't care about the fact that he rammed her car, he can still be charged with it: you don't need a complaining victim to be charged with a DUI. All you need to do is be stupid enough to drink and drive, and then call the cops which is apparently what happened here. I would advise your friend not to try to argue his point because the judge will either 1) laugh at him or 2) be less likely to be lenient with the sentencing.

Most traffic law applies to operation on public roadways, but there are exceptions to that in almost every state's traffic code. In my state, you can be arrested on private property for:

1) Vehicular homicide
2) Reckless Driving
3) Drunken (or Drugged) Driving
4) Driving While Barred
5) Any of the provisions of the accident reporting requirements

I can't say with absolute certainty that your state allows for private property DWI, but I'd be very surprised if it didn't.

If you are in the US, then they can give him a DUI for that. He was about to drive onto the street, and they can stop him from doing that.

In some states (including mine), driving while intoxicated applies to driving a car anywhere -- including your own driveway. There is no requirement that it be on a public street.
