I recently walked out on a lease without ever living there. I found out that one of the bedrooms were illegal and the apartment was legally to small for 4 people. We havent got any of our money back. We were told that the landlord has violated the Security act and the Consumer Fraud act. I want to Cite both of these acts but I cant find anything on the Fraud act. I can only find info on the sale of real estate but nothing on leasing apartments. Any help?

The landlord actually admitted to knowing the apartment was illegal in his Answer to my lawsuit. But he said I signed a lease.

I already spoke to a lawayer. I cant afford to have one to go to court with me do he just gave me all the info he could. He did violate these 2 acts. I was just hoping someone knew where I can get the info from so I can cite it in my ammended lawsuit.

Also I called the zoning officer when my landlord told us that the bedroom needs to be accesible to the upstairs tenants because the circuit breakers are in there. I was told this 2 weeks after we signed the lease. This bedroom would have been occupied by my 14 year old daughter.

Without knowing where you are, there's no possible way to answer your question. I've been a landlord for many years and never heard of either of those "acts" and have never heard of an "illegal bedroom."

You can't resort to self-help measures. The landlord CAN hold you legally responsible, unless you go to court, and only a JUDGE can determine that you had the right to get out.

Remember that an aparment being "too small" is a LOCAL not a FEDERAL regulation, so the Consumer Fraud Act would not apply...b/c that is Federal.

i live in san diego, ca and we have Renter Advocates and renters asssitance here.
these are listed in your white pages, and most large cities have them....ck it out.

if you dont have this listing...then look in the front of the white pages in the Government pages . look for the US Dept of Consumer Affairs or fraud....
