can they be charged with another crime, like kidnapping--for an example? If the court order is a drug trafficking order, is that all thats allowed in court?

If the court order allow the police to tap/tape the phone for drugs and they do so for drugs and happen to find evidence of something else while trying to find evidence of drugs, the person can be charged. This is no different than if they have a warrant to search a house for drugs, find a dead body with a bullet in it, and make a murder arrest. However, the reverse would not always apply; if they have a warrant to look for a person and find drugs in a small drawer, then the court could rule that because the drawer was too small for a person to fit, the search could not have been a search for a person, and dismiss the drug charge.

Phone tapping is a very tricky task. There must be some evidence for suspicion to even allow a tap to be installed and it can still be challenged in court. Any crime that is discovered while conducting a legal wiretap may be prosecuted.

why would a phone be "taped" for drugs? u mean for residue, like in CSI? i guess they could. charged with any crime? sure
