I have heard of some towns passing (or at least trying to pass laws like this). I have never heard of a national law. If there were a national law like this, then it would be taken to court and the law would be tossed out. It is a clear violation of the 1st Amendement in the US Constitution.

Also, you can fly any flag higher than the US flag if you want to. You can fly the US flag upside down. You can fly a foreign flag with a US flag on the same pole. There are all sorts of misconceptions about flying flags in the US. There are no laws saying that flags have to be flown in a certain way. If anyone says different then ask them to provide you reference to the LAW that requires this. The US Congress passed a "Flag Code" that is basically a set of suggestions on how to fly a flag. An individual flying a private flag will not be punished for violating anything in the Flag Code.

This is strictly ettiquite, there is nothing illegal about it.

The rules state no flag can fly higher than the US flag. There are two exceptions: the flag of a church, or the United Nations flag.

If you fly on the same pole, the US flag should be above, and the same size or larger. If they are on two separate poles, the US flag should be slightly higher.

Other rules include the flag should be lighted if flown at night, a multi-purpose 3X5 flag should be flown in its place in bad weather, the blue field should always be up, and if drapped across an east/west road, the blue field faces north. North/west road, the field faces east.

There is no rule that you can't display a foreign flag in the US.

Thre are rulesabotu the placement of US flag relative to foreign flags, state flags, and any other flags.

Not sure they rise to the level of law, more like etiquette and tradition.

edit:

1st poster is partially wrong - they can be on the same pole if US is highest.

I was not aware that this act existed. I know you cannot fly another flag above the U.S. flag and only Texas is allowed to fly it at the same level.
