about a month ago, a coworker went to HR with a bogus story that I and another coworker spoke innapropriately around her, her claim was false, I refused to sign the harrasment write up because it was false. since then she has been fired for lying which proved even more that we were innocent of her claim, still on wednsday, me and this other individual were also fired because of tardiness, without the bogus harrasment charge this would have just been our first write up, but since the charge still stood, the company decided to let us go, I feel that I was wrongfully let go and am being advized by other coworkers that I should pursue legal action, can anyone tell me if I have a case, or can anyone tell me where I can go or who I can talk to to find out.

you are hired "at will" they can let you go for any reason or no reaon at all, and you can quit for any reason or no reason at all.

Yes you have a case, however it will be a long drawn out process to collect! If your company has a corporate level, go over the HR Mgr's head, he has a boss somewhere. Try emailing him/her. This also provides written documentation on your end. What have you got to loose? Nothing. Some Managers and policies need to have checks and balances. You were dealt with unfairly and so will the next person. Get your friend to do the same. Two is greater than one! Also if you are concerned about current income, and you are eligable for unemployment file now while attempting to get your job back. This is easy to do. Not sure what state you are in but most states have a phone or online filing system. You will get to explain in detail and they will open your claim with a full investigation (takes about 2 weeks). If your employer has not fully dotted their "i's" and crossed their "t's" and does not have ample documentation and cannot show proof of rightful termination you may just get your job back or at worst collect unemployment. Don't let this sit. Start now. Been there and done this. Didn't really want the job back, but did collect unemployment for a period of 26 weeks because the employer didn't have any documentation to back up there termination reasons...hope this helps

If you live in a "right to work" State, you won't win. They can fire you for any or no reason. You can try unemployment and appeal the firing. The tardiness may be enough for your employer to win though. I would suggest you just move on.

In some states, employers can terminate your employment anytime they want to for any reason and they are also not required to give a reason.
