If two people are drowning and a person sees them and does nothing. He just stands there to guess who will drown first. Can he be charge with a crime, or at the least negligence.????

Not unless s/he is a certified lifeguard or possibly an EMT or other credentialed individual. The average Joe has NO duty to intervene.

There is no provision to charge a person who is watching drowning of two people. He may not be knowing swimming. If he is standing and watching just for fun sake its against humanity. It does not count as negligency.
