My husband and I decided to divorce a few days ago.
This morning he handed me a w4 and told me to change
it to single claiming my kids.
Should I change it yet. no papers have been filed
for anything....seperation or divorce.
Will this mess up my child support?

A W4 forn is filed with your employer, and determines how much tax is taken out of your pay! What your soon to be ex is doing is trying to make sure that you bring home more money, so that he can try to pay less in child support! Before you make any changes, consult your tax advisor! You could end up owing taxes rather than getting a refund!

NO do not change yet! You are not single as of yet and when you file you SHOULD file jointly the first year other wise you could wind up paying big bucks! You and he are STILL married until you BOTH receive a final decree of divorce, what your husband is attempting to do is basicaly defraud the government so that he doesn't have to give you a portion of any refund that the two of you might get if you file jointly. If I were you I'd go to the nearest IRS office and talk to them.

No, it does not mess up child support. It can help when deciding who gets what share of the tax return filed as either joint or separate for the end of year total as well when that comes up in court. Proving you had the children on your W4 for part of the year can prove how much support you had to provide for how long.

don't do anything yet. Wait to talk to your lawyer. You will still claim married for 2007. You were together for more than 1/2 the year so you shouldn't change that. Talk to your lawyer.

Do not sign anything until you consult with a lawyer... Every divorce gets nasty and you need legal advise. Believe me I have been there and done that. Good luck and keep your head up.
