I was involved in an car accident, not my fault, while at work and have been out of work since the accident, 3 years now and my lawywer still has not filed with the at fault party's insurance Co.. Is this normal? I've seen mant doctors, had all the examsetc. How difficult is it to fire one and hire another one or should I?

I have been through Wokman's Comp, which was settled last year to year and a half. At this time I am not going after my Employer, just the at fault insurance companies. I hired this Lawer on 04/2005, does it usually take this long to settle?

I don't know whether this is normal or not, but firing a lawyer is as easy as picking up the phone. Call the lawyer and tell him not to do anymore work on your case and that you want your file. It is your file, so he has to give it to you. I would make sure I had another lawyer ready to go before firing him.

You haven't said whether or not you present attorney has accomplished anything. If not then as suggested sit down with him/her and ask for a reason there's been no action.

If your present lawyer is working a on a contingency basis you may have to pay him/her to get your file. I don't know if the file they have on you would really be needed. A new lawyer would start their own. Their approach to your case would be completely different I'm sure.

Maybe one of the reasons there's been no action is because your present lawyer does not feel there are grounds enough to go after your employer. Sounds to me like it's a workers compensation claim. If it is your lawyer needs to be dealing with your previous employers Workman's Compensation Carrier.

If your present attorney does not specialize in WC claims then I definitely would be looking for one that did.

First you could find another attorney. Then ask for a substitution of attorney. From what you have said your attotrney currently must withdraw if you get another attorney. Plus if you feel like she has not been doing work on the case and has let it just still there then you can call the Bar Grievance Committee. But please talk to to her ot him and discuss your concerns with the lack for forwardness with the case. See if they are will to diligently pursue this matter and explain to them the importance of the matter. Have you been billled or is it on a contigent fee basis? I think you would benefit by talking to the attorney and talking to another attorney to further guide you. God Bless you in this situation and always.

Is your lawyer getting you the result? Are your expenses paid? Are your wage compensated? or all of that on hold?

Ask him for his plan point blank and see what he says.

Changing a lawyer is easy. Tell him you no longer require his services and to close your case. Follow it up in writing. You will likely be billed for all of his services up to that point. Get all of your record and go find someone else.
