I went through a divorce last year. My husband moved out of state. I have sole legal custody and placement of our daughter. He has not visited her ONE time in the last 18 months. He doesnt call much, write, or send gifts. Should he decide to move back closer to us, could he file to receive joint legal custody and placement. I believe this falls under abandonement.

My daughter no longer knows him, and has bonded with other father figures. I am deeply afraid that all the sudden my Ex will decide he no longer wants to pay support and will move back and try to get partial custody just to save a few dollars.

keep good and clear records in a book. If and when he takes you to court you will have your documentation. He still has a right to be in the childs life, after all he is the father.

doesnt work that way at all he has to show most courts a reasonably amount of interest to even be able to see the kids and get visitation there is no way that the custody order can be changed unless going back to court which wont happen especially since he hasnt seen the kids most courts will do whatever is best for the kids but it wont go that far

Yes he can depending on the circumstances specific to your case.

You are making a lot of assumptions. Something the court will not do.

its up to the court but usually they let the father see the child every other weekend just dont go into the court room and say u dont want the father to see your child because then they'll let him see the child whenever or even have custody ma bros ex g/f went in the court room and said that i dont want ma child to see her father and the judge said ooo yaaa then the father can see her whenever he wants my bro now gets her every weekend and on special holidays

Depends on the lawyer he can afford. Always keep records on what he does.
