What if the wrong person unlawfully held and tortured was a u.s. citizen? ...let's say a family member? ...would there be a louder outcry in the u.s. ...what if it was a u.s. citizen wrongfully held and tortured in... say... iran?

exactly mccleary. the u.s. was incensed and cried foul when it happened to u.s citizens and the perp was iran.

You are incorrectly assuming that the CIA illegally detained someone and illegally tortured someone. Since the Supreme Court declined to hear the case, it means there is no evidence to support such claims.

I live in the US. It is OK with me if the US tortures someone to get vitally needed information. It is not OK with me if other countries torture US citizens

It is not written anywhere that we cannot have a double standard. "All's fair in love and war."

Well, it happens all the time in the U.S. to US citizens and aliens alike and for a US citizen to be able to sue the US government, the citizen must prove the government employees acted with knowledge that they had the wrong person.

What would they do if it happened in Iran?

You must be too young to remember the Iran Hostage situation where over a hundred US citizens were kidnapped, tortured and held in Iran for over a year. They were released when they lost their propaganda value.
