If so what is the process... basically the person is $7,000.00 in debt and I would like to know can a lien be placed on a brand new vehicle that was purchased.

It depends on your state laws and if the person bought the vehicle cash outright (aka they have the title with no lien holder period) or if they financed it through a bank that holds the title. Also it depends on whether it is joint property or owned in a trust or under a business. To answer your question without knowing what state you are in or more details regarding the purchase the answer is most likely yes but good luck. Debt collection including for child support is difficult. You will most likely have to pay an attorney a lot of money to collect or hire a child support based debt collection company. To sum it up nicely 80 percent of all court judgments are never collected, not one penny. You are best to go after the persons tax returns that is the easiest and probably fastest route in your case.

A vehicle can be a lien when its owner fails to pay an obligation such as child support. A simple action for replevin will be filed in court in order that the vehicle will be attached to guarantee the payment of the child support.

A lien can, in theory be put on any private property, including a car. But it is so easy to sell a car if you hold the title that it is not trackable.

Wisconsin does this. It prohibits the person from selling the vehicle.

It doesn't do anything to get the child the money owed, it just prevents dad from selling the car and keeping the profits.
