My grandma and granddaddy gave my mom a bedroom suite belonging to my grandaddy's mother over 10 years ago. They brought it to her house and dropped it off, saying they knew it would be taken care of. My granddaddy had a stroke 6 months ago. My grandma and mom got into an argument resulting in grandma and my mom not talking. My grandma has sent a note saying she wants the furniture back or she is taking a warrant out on my mom. If there is anyone with a legal background, what can be done? If the furniture has to be returned is there anything wrong with asking for storage fees for the last 10 years?? Any help is appreciated!

My grandfathers' stroke left him in very bad condition and he is not able to communicate. This furniture belonged to HIS mom.

that's not right .Indian giver.thy will work things out though i think.she cant take bake legally any way.

Sticky situation. If the furniture was given as a gift, then your grand parents no longer have a claim on it. It the furniture was loaned, instead of given, then she could demand that it be returned. I don't think that you can claim storage fees for holding the furniture for 10 years. Since you got use out of it for the time that you had it. Myself, if she wanted it back then I would give it to her. Just sit it on her front porch and say here it is, thank you for the loan of it. Then let Grandma worry about getting it inside the house. You can be vindictive also, if that's the way she wants to play.

Hi,

Your mom does not have to give the furniture back because your grandparents gifted the furniture to her with no strings attached.

Your grandmother cannot take out a warrant against your mother.

What she would have to do is sue your mother in small claims court for the return of the furniture.

As long as it was gifted to her your mom does not have to give it back to her.

The furniture need not be returned. The gift was unconditional, and the giver has no further claim.

She can get it back ONLY if she proves that it was not a gift. That just isn't likely to happen.
