I've been renting a house with my wife now for about 1 1/2 years. My wife though has been living here for a little over 7-8 years. She has 2 children, the oldest is 7, and we have a new born that is going to be 1 this Christmas. The house that we live in, is probably close to 60-70 years old and is very run down. I painted the inside of the house living room, bedrooms and bathroom myself about 1 year ago. I am an amatuer, just used basic coat of paint to cover up scratches and filled in holes. My wife said that her and her family painted it themselves also about 6 years ago, also an amatuer job, basic coat cover up. I suspect that the original paint in this house, throughout is lead based. I feel that the landlord/Owner has never fixed anything of original condition. If I find out that My wife and her kids have been living here in a lead and mold environment for 7yrs "kids", since birth and me for almost 3yrs. Can I sue them for not complying when state laws changed for lead paint?

Before you even think about going down that avenue you had better have the paint tested so you can PROVE that there is lead paint there. Additionally, lead paint that has been covered with non-lead paint does not pose a hazard as the lead has to be ingested to create a problem.

idk cuz if there IS a mold and lead paint problem she should hav complained years ago, but the way this world is u could prolly sue him, yea...and if china has 2 recall all their stuff 4 lead paint ur landlord is guilty 2, but make sure it IS lead paint so u dont make a fool of urself...i saw in this society sue him if it turns out 2 b lead, but mold could also b considered ur problem 4 not tryin 2 clean it off, ya kno...
