A very close friend of mine has been married for 3 months. The other day, he found out that she is cheating on him and he told her that he wanted a divorce. She lives in the home with no children and because he doesnt want to be around her, he has taken him and his child (previous relationship) to a friends house. She has no job and he pays all the bills. Is there a way that he can have the house and she move home with her parents? He lived in the home before her and signed the lease a few years ago. She has been staying with her new "boyfriend" but wont vacate. What should he do prior to divorce?

We live in Wisconsin. It is a marital property state. It doesnt matter how long you have been married, everything get seperated.

Oh by the way, it is my husbands best friend. Nice try with "digging my claws into him"...what an idiot!

If her name is not on the lease she has no legal right to live there. He can give her 30 days notice of eviction and kick her out legally. Tell him to have the local sheriffs office send her an eviction notice.

OK I'm divorced with 2 children for one if the law in my state says that if the marriage is less than a year they do not have the right to take from each other so if the home was his before he needs a cop to tell her to leave but he will have to give her 30 days to move..... this will be a long road for him but once a cheater always a cheater.................

he needs to see an attorney but because he has the child and signed the lease he will get to keep the house and she has to move. It may be that he has to serve her with an eviction notice - not sure about that so an attorney would be the one to ask.

she should be the one to leave!! If she is not staying there have him move back in and throw her stuff out get new locks, call her up and tell her to get her crap. then file for divorce.

If he has lived there before her and if his name is the only one on the lease then that is his house.

well, tell him to move back in, and call the police on the boyfriend. the boyfriend is a trespasser. then apply for divorce, since it sounds like the home was his before he met her, then it should remain his, no problem, but she won't be forced to leave until he is no longer married to her. but, he CAN get the police to remove the boyfriend.

Tell him to take his child back, and TELL her to get out. If she won't leave, tell him to call the cops. His name is on the lease, he is the one that has lived there. They will be on his side.

cheating after 3 months! That's pretty bad. They should just call it quits now before it gets uglier.
