I would look at the line of cases holding that there is a federal Constitutional right to abort a child. Roe v. Wade and Planned Parenthood v. Casey are the most important, as well as Gonzalez v. Carhart, decided last term. The problem with the reasoning of these cases is that they found a Constitutional right where, admittedly, there was none. The U.S. Constitution does not mention or guarantee a right to privacy explicitle, but the Court found that certain other Amendments, notably the First, Fourth, and Fourteenth, contained "penumbras and emanations" that suggested the Founders intended for privacy to be an implicit right.
The easiest way to challenge abortion as a federal right is to argue that the Constitution should be read as a limiting document on government, not an expansive document on human rights. The role of the states, the argument goes, is to ensure human rights, while the role of the federal government is to enforce federal policy only.

You should probably start with the judicial activism that made it illegal for the people or elected officials to decide if it should be illegal. The Supreme Court says our constitution says it should be legal based on privacy rights. The belief is that the woman's body is her own and she can do with it what she wants but for some reason this does not include her use of drugs.

Well the obvious anti abortionists will state that from the millisecond that an egg is fertilized by a sperm it has the rights of every human being on the planet , which includes Life, liberty and the persuit of happiness. Though it is only composed of a couple undifferentiated cells, it is the will and destiny of God and therefore should not be tampered with.

I don't understand why the rights of the woman (who did the deed and got pregnant in the first place) supersedes the right of the baby who had nothing to do with being conceived. When does the baby get to choice his/her desires. Oh I forgot they can't they were mutilated and killed.
Abortion is murder. Just because you can do it doesn't mean you should. I am appalled by people who cannot understand this simple concept. Plus no one ever talks about the negative health effects on the woman after she has had these abortions. They only shove "It's your Right" down her throat.

Could it be the Brain stem?
If the the fetus has a brain it must be alive, and, therefore, abortion can be equated to murder but just given another name

Yes: it shouldn't. Although a fetus is obviously a human being from conception on, that cannot give it unlimited rights as against those of the mother, who would have to ingest an additional 50,000 calories to bring it to term, as well as be responsible for the child for years thereafter. Clearly, a compromise is necessary; that laid down in Roe v. Wade was appropriate at the time -- and still is.
