My abusive husband who has kicked, pushed, cursed, told me he only wanted me for my money, cheated on me, and told me that he wanted to trade me in for a younger wife.

I had a malpractice lawsuit and won. The check has my name AND HIS NAME on it. Is he entitled to any of it and if so, how much? Again, this lawsuit was due to an injury that I sustained.

i would really ask your lawyer this, it doesn't make much sense for his name to have been on the check at all....talk to your lawyer before you do anything with that check!

probably 50/50
take your loss and leave that abusive guy. No woman should be treated like that and give a guy the reward in staying with them.
When i read your other questions i can't help noticing that your man is a ***. You should get some self esteem and you will find a other man that's worth spending your live with. but first of all it's time to get your act together.

Well, whether he's entitled to the money or not is secondary here. If his name is on the check, you're gonna have a hard time cashing it without his signature. So, you're going to have to get creative in getting his john hancock on the check, or ask him to sign it and wait for him to extort a portion of the check from you. You're prolly gonna have to spend some of the money on a lawyer now. Unless you can get someone to deposit the check into their bank account via online banking, ie USAA has the online check deposit feature. After they deposit the money into their bank, transfer the money back to you. But of course that has to be someone you can trust 110% to give you the money back after they've deposited into their account. Maybe you could offer them a few bucks to do it for you versus the major drama the old hubby is gonna give you. Good luck!

I am soooo sorry that your husband is such a loser. Unfortunately, your married and his name is on the check so he`s entitled to 50%. I don`t understand why his name would be on the check, it was your injury!!!

Who were the parties involved in the malpractice suit? Was it you AND HIM suing, or just you?
If it was just you then you need to contact the other party's lawyer and advise him/her that the check was misprinted and that you need another in JUST your name.
If both of you were suing then he is entitled to 50%.

It seems he might be eligible for half since his name is on it also.His name shouldn't be on there if you're the one who sustained the injury,though.You should consult a lawyer about both a divorce and the money.The divorce laws in your area might or might not be conducive to you getting all the money.e.g:divorcing him on grounds of physical and mental cruelty.

If the injury was to you then I don't understand why the check would be made out to both of you but that's your business. I would have him arrested for assault and then he could spend his share of the money on an attorney.

Call a lawyer and ask him. Maybe see if the check can be voided and written only in your name because of the circumstances.

Doesn't make sense that his name is on the check if you are the only plantiff listed on the suit. Sounds like he's listed as plaintiff too.

Here in California, half of the check is his.

I would contact the lawyer and demand that the check be wrote out in your name and your name only! Here in MI even if he were still your hubby he wouldn't get anything anyway unless you said other wise.
