It can depend on how they are getting paid. In some contracts the lawyer will only get paid if they win. Under this situation, there is no reason for them to take the case if they think they can't win. The other situation is where they get paid an hourly rate no matter the outcome. Here there is some motivation to take the case no matter what they think the odds are. In this case it will come down to the ethics of the lawyer.

Their job is to consult with you and let you know if there is a case or not. If there isn't a case and they take a client, it's a retainer for the possibility. Why would anyone hire a lawyer if they don't think they have a case? It's a waste of money and probably not a good choice for counsel, if he doesn't think there's a case. Sounds lazy or money hungry.

If the lawyer is ethical he/she will not take a case if there is no reasonable chance for success with it or if they believe there is not even a case. I have worked for attorneys for 7+ years and the ones I have worked for will research the case before giving the potential client an answer.

I've worked in law offices for years and, unfortunately, some attorneys do take cases that they shouldn't. Some take cases when they aren't competent in the necessary field of law (an example would be an attorney who takes on land use cases when he or she is unfamiliar with that area of the law). Some take on cases that are frivolous.
There are good attorneys and bad attorneys.
