Been there! First, get an attorney. This could get sticky and even though there's a cost factor, your going to want to protect yourself in any way possible.

In most states, you'll have to prove to the judge that you don't know your husband's whereabouts by calling family, friends, etc. and keeping a log with the calls you've made (date, times and who you spoke with). Once that's done, then you can print the summons in a paper for 30 days. There is a minimum circulation requirement so make sure your running the summons in an approved paper. After that, you'll have to go back before the judge and prove that you did that (a receipt will usually do as it will have the run dates of the summons). Once that's done, as long as your state doesn't have a "cool off period" the divorce decree is usually signed by the judge and you're officially divorced.

I would surpass the separation and go straight for the divorce honey. First you need to file your paperwork. Ask for a court date that is set out at least two months. Once you have that court date, take out an add in the town of the last known address you have for him. Send a certified copy of the divorce papers to his parents or any other sibling you may be aware of. Then show up in court on your court day with proof of all these things, tell the judge you have no idea where he is, explain how long he's been gone and then waive the rights to any waiting period due to circumstances at hand and get your divorce.

All this works UNLESS your spouse is in the military. If that's the case, you will remain married until he's done since no civil action can be brought against a service man on active duty.

And if you still can't find him, hire an investigator to look for him. If that turns up empty, file a missing persons report with the police. After a certain amount of time, you should be able to, as his next of kin, have him declared legally dead. No divorce necessary.

Go to an attorney and tell him you want a divorce and explain you do not know where your husband is. He will ask you where you think he might be and ask you for an address.
If you husband does not respond to a petition for dissolution of marriage, the judge will order your marriage disolved without his presence.
